GSTIN Suspended or Cancelled? The Revocation Window and How to Use It

Suspension stops you issuing a taxable invoice, and the window to apply for revocation is short. The sequence of forms, what the reply has to contain, and why the final return matters even when you wanted the registration gone.

A suspended GSTIN is a business emergency dressed as an administrative notice. You cannot issue a taxable invoice, your customers cannot claim credit on what you do issue, and the window to put it right is measured in days. Most of the cases we are brought are recoverable — but several arrive after the thirty-day revocation window has closed, which converts a procedural problem into a much harder one.

Here is the sequence, and what each step actually requires.

How a registration gets cancelled

Two routes, and they behave differently.

On your own application. You apply in REG-16, giving the reason — business discontinued, transferred, amalgamated, change of constitution, or no longer liable to be registered — the date from which cancellation is sought, and details of stock held and the liability on it.

By the officer, on their own motion. Section 29(2) of the CGST Act allows cancellation where, among other grounds:

  • a registered person has not filed returns for a continuous period prescribed in the rules;
  • a composition taxpayer has not furnished returns for the prescribed period;
  • a person who took voluntary registration has not commenced business within six months;
  • the registration was obtained by fraud, wilful misstatement or suppression of facts;
  • the person does not conduct business from the declared place, or issues invoices without supply, or contravenes the anti-profiteering or specified provisions.

Cancellation on the officer's motion can be made with retrospective effect. That is the detail that turns a cancellation into a commercial problem: every customer who claimed credit on your invoices during the retrospective period loses it, and they will come back to you about it.

Suspension, which happens first

Where the officer has initiated cancellation proceedings, the registration may be suspended pending the outcome. Suspension also follows automatically on your own cancellation application, from the date of the application or the date sought, whichever is later.

During suspension:

  • you may not make any taxable supply, which means not issuing a tax invoice and not collecting tax;
  • you may not claim input tax credit;
  • you are not required to furnish returns for the period of suspension.

The compliance relief is real but it is not a benefit. Suspension with a live order book is the expensive scenario, and it is why the reply to a show cause notice should be treated as urgent commercial work rather than routine correspondence.

The forms, in order

FormWhat it isTiming
REG-16Your application for cancellationWithin 30 days of the event
REG-17Show cause notice proposing cancellationIssued by the officer
REG-18Your reply to the show cause noticeWithin 7 working days of service
REG-19Order of cancellation—
REG-20Order dropping the proceedingsWhere the reply satisfies the officer
REG-21Application for revocation of cancellationWithin 30 days of service of the order
REG-22Order revoking the cancellation—
REG-23Notice proposing to reject revocation—
REG-24Your reply to that noticeWithin 7 working days
GSTR-10Final returnWithin 3 months of cancellation

Replying to REG-17

Seven working days, and the reply decides whether you end at REG-20 or REG-19.

What a reply that works contains:

  1. The specific ground addressed. REG-17 notices are often terse — "failure to furnish returns", "registration obtained by fraud". Identify the exact allegation and answer that, not the general proposition that you are a compliant taxpayer.
  2. The default cured, with evidence. For non-filing, the single most effective reply is one filed after every outstanding return has been filed and the dues paid, with the acknowledgements attached. An officer with nothing left to remedy has little reason to cancel.
  3. Proof of the place of business, where that is the allegation: the rent agreement, the current electricity bill, photographs of the premises with signage, delivery challans showing movement to and from it.
  4. A reconciliation, where the allegation concerns mismatch or suspected non-genuine supply: purchase register to GSTR-2B, outward supplies to GSTR-1 and GSTR-3B, with differences explained line by line.
  5. A request for personal hearing, made expressly. It is easier to defend a position in person than to have a terse reply read uncharitably.

Applying for revocation

If REG-19 has been issued, the remedy is REG-21, within thirty days of service of the cancellation order. The Additional or Joint Commissioner may extend that by a further thirty days, and the Commissioner by thirty more, on sufficient cause being shown.

Two practical points. File within the first thirty days if it is at all possible — the extensions are discretionary and require you to explain the delay. And for a cancellation ordered on account of non-filing, the returns come first: revocation is not granted while the defaults that produced the cancellation are outstanding, so the sequence is file everything, pay everything, then apply.

Where the window has genuinely closed, the remaining routes are an appeal under Section 107 within the appellate time limit, a writ petition in the appropriate case, or taking a fresh registration. A fresh registration is operationally simplest and often the wrong answer: it does nothing about the retrospective period, leaves the old GSTIN's liabilities live, and the application itself asks about previous registrations.

GSTR-10, the step people skip

The final return is due within three months of the date of cancellation or of the cancellation order, whichever is later. It is required whether the cancellation was yours or the officer's.

It reports stock held on the date of cancellation and the liability on it — because under Section 29(5) a person whose registration is cancelled must pay an amount, by way of debit to the electronic credit or cash ledger, equivalent to the credit on inputs held in stock, in semi-finished or finished goods, or on capital goods, on the day immediately preceding the date of cancellation. For capital goods the amount is worked out on the prescribed pro-rata basis.

Skipping GSTR-10 produces a notice in REG-24 and a late fee, and leaves the registration unresolved indefinitely. We regularly meet businesses that closed down four years ago and still have an open GST obligation because the final return was never filed.

Avoiding the situation

Almost every cancellation-for-non-filing case has the same history: a nil-return period that nobody filed because there was nothing to report.

  • File nil returns. They take minutes and their absence is the leading cause of cancellation.
  • Keep the registered address real and current. Amend it in REG-14 when you move, before the verification visit.
  • Watch the portal. REG-17 is served on the portal and by email to the address on record. If that address is a former accountant's, you will learn about the notice when a customer tells you their credit was denied.
  • Reconcile monthly. The mismatch-based grounds are all detectable in your own data a year before an officer raises them.
  • Close properly. If the business is finished, file REG-16, then GSTR-10, and keep the acknowledgement. An unfinished exit costs more than a finished one.

Frequently asked questions

Can I keep trading while my GSTIN is suspended?

You cannot issue a tax invoice or collect GST, and you cannot claim input tax credit for the period of suspension. You are also not required to file returns for that period while suspension lasts. Continuing to invoice with GST on a suspended registration creates a liability to pay what you collected with no corresponding credit for your customer.

How long do I have to apply for revocation?

An application in REG-21 is to be made within thirty days of service of the cancellation order. That period can be extended by the Additional or Joint Commissioner and then by the Commissioner, each for a further thirty days, on sufficient cause. Waiting for the extension rather than filing inside the first thirty days is a choice to rely on someone's discretion.

The registration was cancelled for non-filing. What do I have to do first?

File every outstanding return, and pay the tax, interest and late fee due on them. Revocation of a cancellation made for non-filing is not granted while the defaults that caused it remain outstanding, so the returns come before the application.

Do I still need to file GSTR-10 if I asked for the cancellation myself?

Yes. The final return is due within three months of the date of cancellation or of the cancellation order, whichever is later, and it is required whether the cancellation was voluntary or ordered. Missing it attracts a notice in REG-24 and a late fee, and it is a common reason an otherwise clean exit stays open for years.
