Terms and Conditions

I. WELCOME TO FASTLEGAL.IN

Since we won’t be meeting in person, it’s crucial to clearly outline the terms of our agreement beforehand. If you have any questions about Fastlegal, please feel free to reach out to us. In this document, the Fastlegal service will be referred to as the “service,” you will be referred to as the “user,” and our agreement will be referred to as the “agreement.”

II. FASTLEGAL.IN ONLY PROVIDES A MEDIUM FOR INTERACTION

Fastlegal is an online platform designed to facilitate communication between legal professionals and individuals seeking legal services. Fastlegal serves as a hub where legal service providers and potential clients can exchange information with the aim of establishing a professional relationship. However, Fastlegal does not guarantee that users will successfully find a lawyer, advocate, or attorney through this system. Fastlegal does not take any stance or provide any opinion regarding the formation of a lawyer-client relationship.

To create an optimal environment for lawyers and clients, Fastlegal does not get involved in the agreements between lawyers and clients or in the actual representation of clients. Consequently, we cannot guarantee the fulfillment of any agreement or the reliability of either party. Users, not Fastlegal, are solely responsible for evaluating the integrity, honesty, and trustworthiness of the individuals they communicate with on this platform.

(a) Disclaimer of lawyer-client relationship

Fastlegal is not a representative of lawyers. Its role is solely to facilitate communication between lawyers and potential clients. Sending electronic communications to Fastlegal alone will not establish a lawyer-client relationship between the user and Fastlegal; this is explicitly disclaimed.

(b) Fastlegal does not promote any User.

Fastlegal aims to assist every litigant in finding lawyers best suited to their needs. Fastlegal is not intended for advertising or solicitation, and the content on the website should not be interpreted as legal advice. Fastlegal may recommend subscribing lawyers if they meet a user’s requirements, but not otherwise. The transmission, receipt, or use of Fastlegal does not establish a lawyer-client relationship. Recipients of content from this website should not take or refrain from taking any action based on the content of this site. We encourage users to independently review lawyer profiles and make informed decisions.

(c) Specifically, Fastlegal does not provide any avenue for solicitation

Fastlegal keeps client information confidential from lawyers until the client chooses to communicate with the lawyers directly or online. As a result, lawyers are not permitted to view private information about potential clients.

(d) Fastlegal does not provide Legal Advice

The information provided in the ā€˜FAQsā€™ section is not legal advice; it consists of commonly asked questions about Will making, Lease Agreement drafting, Cheque Dishonour notices, Money recovery notices, Power of Attorney to collect rent, and other documents that may be added periodically. Users are advised to consult with lawyers for specialized guidance on any of these documents.

(e) Disclaimer of representations by users

Fastlegal makes no representation, guarantee, or warranty (express or implied) regarding the legal ability, competence, or quality of representation that may be provided by any of the lawyers or law firms listed on this site or any of its affiliates.

Please note that neither Fastlegal, nor any of its subsidiaries or employees, are advocates. We are not a law firm and do not provide legal advice. Nothing on our website or in our communications should be construed as legal advice.

Our website, blog, and other materials are intended solely for informational and awareness purposes and are not substitutes for the advice or services of an advocate or legal professional.

When necessary to meet your needs, we will facilitate a connection with a suitable professional such as lawyers, chartered accountants, or company secretaries. Please remember that these professionals are not our representatives, agents, or employees. Our site and services are just one of many sources of information available to you. You may wish to consider multiple sources to make an informed decision.

The decision to engage any of these professionals is important and should be made carefully, based solely on your own judgment. By agreeing to use the services on our website, you give us permission to select a suitable professional on your behalf. If you disagree with these terms and conditions, or do not want us to choose a professional for your request, please do not use our services.

We strive to keep our content and documents accurate, current, and up-to-date. However, due to changes in laws and regulations, we cannot guarantee that all information on the site and in our communications is completely current.

Please be advised that laws, legal requirements, rules, and regulations can be location-specific and may vary from place to place. The general information and other materials we provide cannot address every situation or circumstance.

Our sites and services are not intended to create an advocate-client relationship, and your use of our sites and services does not and will not create any such relationship between you and us under any circumstances.

III. USER GUIDELINES

Users of Fastlegal are granted a nonexclusive, limited right to access and use the service in accordance with the terms outlined in this agreement. To maintain the systemā€™s appeal and utility for all users, it is essential that users adhere to these rules. Fastlegal reserves the right to revoke access to its service for any user who violates these rules, is the subject of complaints from other Fastlegal users, or for any other reason.

The following activities are strictly prohibited on our system:

  • Using foul or inappropriate language.
  • Making racist, hateful, or otherwise offensive comments.
  • Promoting or providing instructional information about illegal activities, or encouraging physical harm or injury against any group or individual.
  • Defaming any person or group, including people of all ages, races, religions, and nationalities.
  • Violating the rights of others, including but not limited to intellectual property rights. This includes acts of copyright, trademark, patent, trade secret, or other intellectual property infringement, such as offering pirated computer programs or links to such programs, information to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs, or any type of cracker utilities (including files intended for game emulation).
  • Violating Internet standards.
  • Using the service to display harassing, abusive, threatening, harmful, vulgar, obscene, or torturous material or invading others’ privacy.
  • Interfering with or disrupting the service or servers or networks connected to the service by posting advertisements or links to competing services, transmitting “junk mail,” “spam,” “chain letters,” or unsolicited mass emails.
  • Compromising the security of the service provided by Fastlegal. This includes attempting to access private system areas of Fastlegal or other users’ accounts.

Users must follow these guidelines to ensure a safe and respectful environment for everyone.

IV. DISCLAIMER OF INFORMATION OBTAINED ON THE SERVICE AND SOME USER SUPPLIED CONTENT

  • Disclaimer of information obtained on the Service

Fastlegal provides a platform for lawyers and potential clients to connect, offering a resource for informational purposes. While intended to be accurate, complete, and up-to-date, Fastlegal does not promise or guarantee the correctness, completeness, or timeliness of the information provided. The accuracy, completeness, or adequacy of Fastlegal is not warranted or guaranteed, and Fastlegal assumes no liability for the interpretation and/or use of the information on this website. The owner of this website does not intend for links to other websites to serve as referrals to, endorsements of, or affiliations with the linked entities. Fastlegal is not responsible for and makes no representations or warranties about the content of websites linked from this site.

Fastlegal will strive to remove any promotional material posted by users attempting to promote themselves on the website. The opinions and views expressed are those of the individual users of the service and do not reflect those of Fastlegal. Data submitted by other users (non-lawyers) is not verified or reviewed before appearing on the Fastlegal website. Please exercise caution when using this site.

Fastlegal makes every effort to verify that lawyers who subscribe to the service are licensed and in good standing with their local bar at the time of registration. However, Fastlegal cannot continuously track, verify, or monitor the standing of lawyers using the service. Therefore, Fastlegal makes no representations regarding the status, standing, or ability of any lawyers or law firms listed on the site.

Users are urged to conduct their own independent investigation and evaluation of lawyers or law firms being considered. The determination of the need for legal services and the choice of a lawyer are crucial decisions and should not be based solely on claims of expertise or the cost of services.

Fastlegal is not responsible for, and does not endorse, any description or indication of specialization or limitation of practice by lawyers or law firms. Although efforts will be made to avoid false information, please note that no agency or board may have certified such lawyers as specialists or experts in any indicated field of law practice. Additionally, lawyers claiming specialization are not necessarily more competent than other lawyers. Users should question lawyers on the factual basis of any claims they make, request the names of certifying agencies, and verify all information independently.

Users are encouraged to use caution when reviewing information submitted by lawyers and other parties. Although Fastlegal requires lawyers to comply with all regulations governing legal conduct, it is impossible for Fastlegal to monitor lawyers’ integrity.

Fastlegal does not endorse the content or legality of any offers, statements, or promises made by lawyers or any other parties, on or off this site.

(b) Disclaimer of content supplied by users in the form of reviews, comments, communications, and other content

At various sections of the Fastlegal website, visitors may have the opportunity to share their thoughts, opinions, and reviews, constituting what we term as “user content”. Fastlegal does not claim authorship or publication rights over such user-generated content. Our role is merely to facilitate the storage and dissemination of these ideas expressed by Fastlegal members. We want to make it clear that Fastlegal holds no responsibility for the content posted by users. Should any inappropriate material come to our attention, we will promptly remove it. Determining the suitability of such content will be at the discretion of Fastlegal.

V. LIMITATIONS ON USE

The information provided on Fastlegal is intended for personal use only and should not be exploited for commercial purposes. Users are prohibited from engaging in activities such as decompiling, reverse engineering, or creating derivative works from Fastlegal. Additionally, using network monitoring software to extract information about the site’s architecture or user activity is strictly prohibited. Without prior written consent from Fastlegal, users may not utilize robots, spiders, or other automated processes to copy or monitor content. Reproduction, modification, or distribution of Fastlegal’s content for commercial, non-profit, or public purposes is not permitted, except where expressly authorized. Users must also comply with India’s export control laws and regulations when using or exporting Fastlegal’s content. Unauthorized use of Fastlegal or its content is prohibited.

VI. CONFIDENTIALITY

Fastlegal endeavors to uphold the confidentiality of all information provided by users within our system and database of legal professionals. However, it’s important to recognize the inherent risks associated with transmitting sensitive information over the internet or via email. While Fastlegal takes precautions to safeguard user data, we cannot guarantee absolute confidentiality due to factors beyond our control. Users are advised to exercise caution when disclosing sensitive information and refrain from making confessions or admissions online. It’s advisable to outline legal issues or disputes in general terms initially, with specific details shared only after engaging directly with a chosen lawyer or attorney outside our platform, such as through a phone call or appointment. Lawyers utilizing Fastlegal’s services are expected to refrain from soliciting specific or confidential information through the platform. Fastlegal holds no liability for any unauthorized release or misuse of user information by other users or as a result of system errors or failures.

VII. INDEMNIFICATION

By using this service, the user acknowledges that Fastlegal assumes no responsibility for any potential harm resulting from their utilization of the platform. The user agrees to indemnify, defend, and hold Fastlegal harmless from any liabilities and expenses incurred due to their use of the service, including any claims, demands, damages, or losses arising from the content or usage of the service. This indemnity also extends to any breaches of the user agreement, representations, warranties, or covenants made by the user. The user agrees that this indemnity encompasses legal fees and costs and applies to Fastlegal, its founders, officers, and employees. Fastlegal reserves the right to assume exclusive defense and control over any matter subject to indemnification by the user, and the user may not settle any such matter without Fastlegal’s written consent.

VIII. COMMUNICATIONS AND OTHER DATA

Fastlegal is not responsible for any loss of data resulting from accidental or deliberate deletion, network or system outages, backup failure, file corruption, or any other reasons.

IX. LICENSE OF YOUR CONTENTS TO FASTLEGAL

By submitting content to Fastlegal, you grant (or warrant that you have the right to grant) Fastlegal a perpetual, royalty-free, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute such materials. This license extends to incorporating the materials into any form, medium, or technology, whether known now or developed in the future. While Fastlegal assures users that sensitive information will not be intentionally disclosed to third parties, it’s important to note that the granted license applies to all submitted materials.

X. FASTLEGAL PROPRIETARY RIGHTS

Except where explicitly stated in these terms and conditions, nothing herein grants any license or right, whether implied or otherwise, under copyright or other intellectual property rights. Users acknowledge that the content and website of Fastlegal are protected by copyright, trademark, service marks, patents, and other proprietary rights and laws. Users agree to use the material and information provided on Fastlegal only as expressly authorized by Fastlegal and may not copy, reproduce, transmit, distribute, or create derivative works without express permission. Users acknowledge that Fastlegal may display images and text throughout the service. Users are prohibited from extracting and publishing any information from the system, electronically or in print, without permission from Fastlegal and all relevant parties. This prohibition extends to all content on the system. Users are advised to contact Fastlegal before copying or reproducing any material found on the platform for reproduction or distribution purposes.

XI. LINKING TO FASTLEGAL.IN

Users are encouraged to share links to the homepage of Fastlegal, on the condition that they do not alter or obscure any part of the homepage through framing or other means. Additionally, users should comply with any requests from Fastlegal to discontinue providing links to the site.

XII. ADVERTISERS

FASTLEGAL may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on Fastlegal is accurate and complies with applicable laws. Fastlegal will not be responsible for the illegality of or any error or inaccuracy in advertisers’ or sponsors’ materials.

XIII. REGISTRATION

Certain sections of Fastlegal may require user registration. By registering, you agree to provide Fastlegal with accurate and complete information. It is your responsibility to update Fastlegal of any changes to your registration information. Each registration is intended for individual use unless otherwise specified. Fastlegal prohibits sharing registered accounts or allowing multiple users to access the platform under a single name. Users are responsible for preventing unauthorized use of their accounts. If unauthorized use is suspected, users should promptly notify Fastlegal. Failure to comply with these terms may result in termination of user rights.

XIV. ERRORS AND CORRECTIONS

Fastlegal does not guarantee that the service will be free from errors, viruses, or other harmful components, nor does it guarantee that defects will be corrected. Fastlegal reserves the right to make improvements or changes to its features, functionality, or service at any time.

XV. THIRD PARTY CONTENT

Third-party content may be present on Fastlegal or accessible through links on Fastlegal. Fastlegal is not liable for any errors, inaccuracies, defamation, libel, obscenity, or profanity in such third-party content. Users understand that the information and opinions expressed in third-party content are not endorsed by Fastlegal and do not necessarily reflect Fastlegal’s beliefs.

XVI. UNLAWFUL ACTIVITY

Fastlegal retains the authority to investigate complaints or reported breaches of the Agreement and to take necessary actions, including but not limited to reporting suspected unlawful activities to law enforcement, regulators, or other relevant third parties. Fastlegal may disclose any pertinent information, such as user profiles, email addresses, usage history, posted materials, IP addresses, and traffic data, as deemed necessary or appropriate to such entities.

XVII. REMEDIES FOR VIOLATIONS

Fastlegal retains the right to pursue all available legal and equitable remedies for violations of the Agreement, including but not limited to the option to block access to Fastlegal and its features from specific Internet addresses.

XVIII. SEVERABILITY OF PROVISIONS

The Agreement and the Privacy Policy together form the complete agreement regarding the use of the service offered by Fastlegal. If any provision of these terms and conditions is deemed unlawful, void, or unenforceable, it will be considered separate from the remaining provisions, which will remain valid and enforceable.

XIX. MODIFICATIONS TO TERMS OF USE

Fastlegal reserves the right to modify the agreement at any time. Users are responsible for reviewing the Terms and Conditions periodically. Continued use of the service following any changes indicates acceptance of the updated terms and conditions.

XX. MODIFICATIONS TO SERVICE

Fastlegal reserves the right to alter or cease the service, either temporarily or permanently, with or without prior notice to users. Users acknowledge that Fastlegal shall not be held liable to them or any third party for any modifications or discontinuations of the service. Users also understand and agree that termination of service under any provision of the agreement may occur without prior notice, and Fastlegal may promptly delete data and files from the user’s account and restrict further access to such files or the service.

XXI. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

A significant concern for Fastlegal, as well as for all operators of online platforms, is the potential for being held liable for the misconduct of our users. If one user defames another user, the victim may wrongfully attribute responsibility to us, despite the fact that the offending user is truly at fault. Similarly, if a user uploads a virus-infected program leading to damage on other users’ computers, we may face blame even though it was the user who introduced the virus onto our platform. Likewise, if a user transmits illegal or inappropriate information to another user, we might unfairly bear the blame, even though we merely facilitated the exchange between users. Therefore, it’s essential for all users to acknowledge their individual responsibility for their actions and understand that any harm caused by another user should be attributed solely to that user, not to Fastlegal.

While Fastlegal strives to deliver reliable and high-quality systems to users, occasional mistakes or system failures may occur. Such issues are inevitable given the scale of operating a system like ours. However, it would be impractical for us to assume blame or financial liability for any usability problems, system failures, errors, or damages of any nature. In order to sustain and enhance our service, Fastlegal must disclaim any warranties regarding this service and emphasize that our liability for any issues related to the use of our system is strictly limited.

These needs are accomplished by the following disclaimers:

(a) Disclaimer of Warranties

The user acknowledges and agrees that the use of the service is solely at their own risk. The service is provided on an “as is” and “as available” basis. Fastlegal explicitly disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Fastlegal does not warrant that the service will meet the user’s requirements, be uninterrupted, timely, secure, or error-free. Additionally, Fastlegal does not guarantee the accuracy or reliability of any information obtained through the service, nor does it warrant that defects in the software will be corrected. Fastlegal also does not warrant any goods or services purchased or information obtained through the service or any transactions entered into through the service. Users understand that no advice or information, whether oral or written, obtained from Fastlegal, shall create any warranty not expressly stated herein.

(b) Limitation of Liability

The user agrees that Fastlegal shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the service, or from the cost of procuring substitute goods and services, or from any goods or services purchased or obtained, or messages received, or transactions entered into through or from the service, or from unauthorized access to or alteration of the user’s transmissions or data. Such damages include, but are not limited to, loss of profits, use, data, or other intangibles, even if Fastlegal has been advised of the possibility of such damages. Additionally, the user agrees that Fastlegal shall not be liable for any damages arising from interruption, suspension, or termination of the service, whether justified, negligent, intentional, or inadvertent, including but not limited to direct, indirect, incidental, special, consequential, or exemplary damages.

XXII. ARBITRATION

Any dispute or claim arising from or related to this Agreement or Fastlegal services shall be resolved through binding arbitration in accordance with Indian laws. Such arbitration shall be conducted individually and may not be combined with any other claim or controversy involving another party. Additionally, any other legal disputes or disagreements will also be resolved in accordance with Indian laws, and the courts of Chennai shall have jurisdiction over all such matters.
